General Terms and Conditions

Contract Content

The subject of this contract is the careful care of dogs by the dog walking service of Fiona Elaine Spedding (hereinafter referred to as “Un-Leashed”).

1. Scope / Subject of Contract

These general terms and conditions govern the conclusion, content, and execution of the contract for services provided by Un-Leashed in the sense of a contractual relationship according to the Swiss Code of Obligations OR.

2. Contract Components

2.1. Health Status, Vaccination Protection, and General Behavior of the Dog

  1. As the client and dog owner, you confirm to Un-Leashed that the handed-over animal is your property; that it is healthy, free from contagious diseases, and vaccinated against the following diseases (see lit. b) in terms of basic immunization.
  2. The following dogs cannot be accepted by Un-Leashed:
    • Dogs with parasite infestation
    • Dogs suffering from a contagious disease
  3. Un-Leashed alone decides who may participate in group walks.
  4. As a dog owner, you are obligated to inform Un-Leashed without prompting about the following points:
    • any important characteristics of your animal (aggressiveness, fearfulness, etc.)
    • existing cantonal requirements concerning the dog or dog ownership
    • behavioral abnormalities
    • mental or physical limitations of the dog
  5. If your animal becomes ill or suffers an injury, Un-Leashed is authorized to consult a veterinarian. Should veterinary treatment be deemed necessary, all associated costs are to be borne by you. Transport to and from the veterinarian will be charged according to effort. The costs are to be paid by you on the same day.
  6. In case of serious illness or high care requirements for your animal, it will be transferred to a veterinary clinic at your expense. The effort will be invoiced to you.
  7. If an animal dies, it will be handed over to a veterinarian for safekeeping. The collection and burial of the animal is carried out by you and at your expense.

2.2. Liability

  • a) With your booking, you confirm as a dog owner that a legally valid liability insurance exists and that the dog is included in it.
  • b) Un-Leashed disclaims any liability for the escape of your animal as well as for any health damage to the animal, unless Un-Leashed can be proven to have violated the duty of care.
  • c) No liability is assumed for brought items (e.g., baskets, leashes, blankets, bowls).
  • d) Should your animal be injured during the stay, should it get lost or die, you will not make any claims for damages and/or compensation.
  • e) You as the owner are liable for all damages caused by your animal. This also applies to incurred veterinary costs, unless there is intent or gross negligence on the part of Un-Leashed.
  • f) For animal care at the animal owner’s residence: If the animal owner provides an incorrect key, the costs for the locksmith service as well as the resulting waiting time must be fully borne by the animal owner. If the execution of the order is not possible at all, the agreed costs must be paid in full.
  • g) The liability of Un-Leashed is limited to intent and gross negligence. In particular, Un-Leashed is not liable for injuries to the animal that may arise from group housing, for illnesses of the animal occurring during and after the care period, parasite infestation, or for damage to brought items such as leashes, collars, etc.

2.3. Care

  • a) Unfortunately, we cannot accept socially incompatible dogs. In this case, we offer activity walks (individual walks) at your residence.
  • b) We justify your trust through animal-appropriate and behavior-appropriate dog care.
  • c) We adhere to the Animal Welfare Act and its ancillary provisions.

2.4. Prices and Bookings / Payment Default

  • a) Payment of the amount owed for walks, subscriptions, or day and vacation stays is made in advance by bank transfer or cash payment.
  • b) Prices vary depending on the zone and can be found on the price list separately available at Un-Leashed and published on the internet.
  • c) We accept your bookings exclusively in written form by letter, email, or via the form.
  • d) Upon request, you will receive a monthly receipt as a customer for all paid services.
  • e) We reserve the right to charge a reminder fee in case of payment default.

2.5. Drop-off and Pick-up

Un-Leashed picks up the dog for the walk at your location and brings it back to your home after the walk. Within the different zones, there are different prices that are shown on the Un-Leashed website.

2.6. Appointment Rescheduling / Appointment Delay / Canceling Booking / Terminations

  • a) If the animal cannot be brought to your home or picked up by you by Un-Leashed at the agreed time, this must be communicated to Un-Leashed immediately. The additional hours and further efforts made by Un-Leashed (driving kilometers and any other costs incurred or invoices from third parties) are to be reimbursed by you.
  • b) Cancellations of booked walks with Un-Leashed must be communicated in writing (email, WhatsApp, SMS) by 5:00 PM the evening before at the latest. More short-term cancellations will be charged to you at 50%.
  • c) Un-Leashed reserves the right to refuse or terminate customers at any time if the dog is not manageable or the terms and conditions are not adhered to.
  • d) If the service cannot be provided due to illness of Un-Leashed employees, the customer must arrange an alternative solution themselves.

3. Final Provisions

  • a) Your personal contract and billing data are subject to data protection and will not be passed on or sold to third parties. The data serves solely for internal processing and billing.
  • b) With your consent to these terms and conditions (by signature or electronic confirmation), you confirm that you have taken note of, understood, and accepted them.
  • c) Un-Leashed has business liability insurance.
  • d) The invalidity of individual provisions
